Former President Trump Seeks Top Court Approval for Military Reserve Troop Deployment in Illinois

On the last weekday, the administration submitted an urgent appeal to the US supreme court, asking for approval to station state guard personnel to Illinois.

This action is part of a wider effort to expand the internal deployment of the armed forces in several cities run by Democrats.

Legal Battle Over Guard Activation

In an immediate request, the US Department of Justice asked the judiciary to set aside a lower court ruling that had blocked the stationing of several hundred state guard troops to the Chicago area.

The presiding judge had voiced concerns about the administration's reasoning for deploying forces, questioning its reasoning in considering local conditions.

A appellate court upheld the initial ruling on midweek, leaving the deployment on pause while the legal challenge continues.

Administration's Claims

The solicitor general, acting for the administration, claimed in the recent request that federal law enforcement have repeatedly been “menaced and assaulted” in the city of Chicago and the outlying area of Broadview community.

This site is home to an Immigration and Customs Enforcement detention center.

The president has previously deployed state guard forces to Chicago, Illinois and Portland, Oregon, following earlier deployments to Los Angeles, Memphis, Tennessee, and Washington, District of Columbia.

The president has stated that military intervention is required to curb unrest and bolster border control.

Political Pushback

Elected Democrats have pushed back sharply the decision, claiming that the president’s claims are overstated and politically motivated.

They allege the president of exploiting his executive power to punish opponents.

The judiciary have also expressed doubt about the government's portrayal of the situation.

City officials state that demonstrations over ICE activities have been largely small and calm, contrasting with the president’s description of “combat area” circumstances.

Statutory Grounds

At the core of the dispute is the government's invocation of a US code allowing the commander-in-chief to federalize the military reserve only in situations of rebellion or when “powerless with the standard military to carry out the statutes of the US”.

The government argues that the troops are necessary to protect federal property and agents from protesters.

Previously, the administration federalized several hundred troops of the Illinois national guard and directed more Texas national guard personnel into the Illinois.

As state authorities criticized the decision, the White House escalated his rhetoric, demanding the apprehension of the city's leader and the governor of Illinois, both Democrats, alleging them of neglecting to protect federal agents.

The state of Illinois and Chicago together took legal action against the government to stop the sending.

On the ninth of October, Judge April Perry, a Biden appointee, handed down a temporary injunction preventing the command.
